New ATF Guidance Intends To Require NFA Registration of Certain Stabilizing Brace-Equipped Pistols

Orchid Advisors was notified by the ATF of a Federal Register Notice titled “Objective Factors for Classifying Weapons with Stabilizing Braces.” The Notice publishes the objective factors the ATF considers when evaluating firearms with an attached stabilizing brace to determine whether they are considered firearms under the National Firearms Act and/or the Gun Control Act. An unpublished Notice is available today in the Federal Register though the formal Notice will be published tomorrow, December 18, 2020. The Notice invites comments from the public for 14 days, beginning on the 18th and prior to issuing final guidance.  Comments may be submitted through www.regulations.gov (reference docket number ATF 2020R-10).
