NYS Senate Advances Another Amendment to the SAFE Act

(Download or read below) On June 21, 2013 at 2 am, the New York State Senate passed SB-4536 (2013) by a vote of 49-14 to create an exception for retired members of the law enforcement community to the large capacity ammunition feeding device limitations.  The companion Assembly bill, AB-6356A (2013) passed on May 23, 2013 by a vote of 116-13.  If signed into law by NY Governor Cuomo, the bill would add NY Penal Law §265.00(25) to define “Qualified Retired New York or Federal Law Enforcement Officer.”  It would also set the criteria and qualifications to come under the exemption.  And, it would allow for the registration of an “assault weapon” (NY SAFE Act defined under NY Penal Law §265.00(22)) by such persons, meeting certain criteria and qualifications.
